Claiming debts owed to the deceased

If you are the administrator or executor, it is your responsibility to collect any debts owed to the deceased. Any money debts owed to the deceased count as part of the 'estate'.

Business debts

If the business was a partnership, the deceased's executor is entitled to remove their capital from the business. Any future profits can be used by the remaining partners, unless they continue to use the deceased's partnership property.

Business dents can be complicated to sort out on your own so its best to seek independent legal advice.

Debts owed by the deceased

Any debts owed by the deceased should come out of their estate. You are only responsible if you had a joint loan agreement or guarantee with that person - you are not automatically responsible for a wife's, husband's or civil partner's debts

If there's not enough money to pay off the debts

In that case, any outstanding debts have to be paid off from the estate before anything is given to the people named in the will, or until the money runs out.
